Terms of Participation in the Lottery
1. Scope
1.1. The organizer of the lottery is OpenSynergy GmbH, Rotherstraße 20, 10245 Berlin (hereinafter referred to as "OS").
1.2. The conditions of participation apply regardless of the medium on which the lottery has been published. Media on which OS lotteries are published include, in particular, on-site lotteries at trade fairs or on social media such as LinkedIn.
2. Eligibility
2.1. All natural persons of legal age who have reached the age of 18 are eligible to participate.
2.2. Persons who violate the conditions of participation, use unauthorized aids, or otherwise gain advantages through manipulation will be excluded from participation in the lottery. OS may also declare such exclusion retrospectively, revoke prizes, and reclaim them if the nature of the prize allows this.
3. Subject of the lottery
3.1. The subject of the lottery is the prize as described in the announcement for the corresponding lottery. The prize is neither transferable nor exchangeable and its value will not be paid out in cash.
3.2. OS is entitled to make reasonable changes to the prize. In doing so, OS may take into account the value of the prize, the interest of the winners in the prize, and the circumstances that make an exchange necessary.
4. Participation, eligibility to win
4.1. Any natural person who, during the period of the lottery, performs the action specified in the announcement (e.g., answering a question, commenting on a post, liking, sharing) with the intention of participating may take part in the lottery.
4.2. Each person may only participate once per lottery. Attempting to participate multiple times may result in the participant being excluded.
4.3. The lottery begins with its publication. The closing date for entries is the date specified in the announcement or the end of a specifically designated event. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
4.4. Participation is free of charge and is not linked to the purchase of goods or the use of services. There is no entitlement to participate in the lottery.
5. Determination and notification of winners
5.1. The winners will be selected at random from all participants after the end of the participation period.
5.2. The winners will be notified immediately, but no later than one month after the winners have been determined (e.g., by email or direct message on the respective social network). All winners notified in this way are obliged to immediately declare their acceptance of the prize to OS and to provide their extended contact details for the prize to be sent. If OS does not receive such notification within one week, the opportunity to accept the prize will be forfeited and OS reserves the right to select another winner. The originally selected winner shall have no claim to compensation in this respect.
5.3. Acceptance of the prize does not generally incur any additional costs, unless customs duties or import sales taxes are incurred for shipping the prize. If different information is provided in the announcement for the relevant lottery, this shall take precedence.
6. Liability
OS shall be liable without limitation in cases of intent or gross negligence, as well as for injury to life, limb, or health. OS shall not be liable beyond this. The above limitation of liability also applies to the personal liability of OS employees or third parties engaged by OS.
7. Data protection
7.1. Personal data is processed during implementation and execution. OS is responsible for the collection, processing, and use of participants' personal data. OS will only use participants' personal details and other personal data in accordance with the legal provisions of data protection law.
7.2. If participants have separately and voluntarily consented to receive OS's newsletter, OS will process the data provided, in particular name, email address, and company name, accordingly. 7.3. If consent to receive the newsletter is not given, OS will process the participants' data exclusively for the purpose of communicating and issuing the prize.
7.4. The name of the winner(s) will only be published on social media channels if the winner(s) have given their express consent. Otherwise, the publication will be in pseudonymized form.
8. Changes to the conditions of participation; premature termination of the lottery
8.1. OS reserves the right to change the conditions of participation, in particular for technical, legal, and business reasons that prevent the proper execution of the lottery. Any changes will be communicated to participants in an appropriate manner.
8.2. OS reserves the right to terminate the lottery prematurely, in particular due to an error or for technical, legal, or business reasons, without being obliged to give prior notice or state reasons.
9. Final provisions
9.1. Legal recourse is excluded with regard to the determination and notification of winners. Otherwise, German law applies to disputes in connection with the lottery.
9.2. Prticipants are obliged to behave in a legally compliant manner when participating. OS accepts no liability for legal violations committed by participants during their participation.
9.3. Should the conditions of participation contain invalid provisions, the validity of the remaining provisions shall remain unaffected.
